Terms of Service

1. Agreement to Terms

By accessing or using Lawnify ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Lawnify is an AI-powered lawn care planning platform that helps users maintain healthy lawns. Our services include:

  • AI analysis of lawn photos to identify grass types and conditions
  • Personalized lawn care plans based on your location and climate
  • Task scheduling and reminders for lawn maintenance
  • Educational content about lawn care best practices

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account using Google Sign-In. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

3.2 Account Requirements

  • You must be at least 16 years old to use the Service
  • You must provide accurate and complete information
  • You must not use the Service for any illegal purposes
  • You must not share your account with others

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may delete your account at any time through your account settings.

4. Subscriptions and Payments

4.1 Free and Paid Plans

Lawnify offers both free and paid subscription plans. The features available depend on your subscription level.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. You agree to provide current, complete, and accurate payment information.

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds will be provided for partial billing periods.

4.4 Price Changes

We reserve the right to change subscription prices at any time. Price changes will be communicated in advance and will apply to your next billing cycle.

5. User Content

5.1 Your Content

You retain ownership of any content you upload to the Service, including lawn photos and lawn information ("User Content"). By uploading content, you grant us a license to use, process, and store it for the purpose of providing the Service.

5.2 Content Guidelines

You agree not to upload content that:

  • Violates any applicable laws or regulations
  • Infringes on intellectual property rights of others
  • Contains malware or harmful code
  • Is offensive, defamatory, or otherwise objectionable

5.3 AI Processing

Your lawn photos will be analyzed by AI systems to provide lawn care recommendations. By using the Service, you consent to this processing. We do not use your photos to train AI models without your explicit consent.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Lawnify and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • AI analysis results will be 100% accurate
  • Following our lawn care recommendations will guarantee specific results
  • The Service will meet your specific requirements

Lawn care results depend on many factors including weather, soil conditions, and proper execution of care plans. Our recommendations are guidance only and not guarantees.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAWNIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to your data
  • Any errors or inaccuracies in AI analysis or recommendations
  • Any damage to your lawn or property

Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Lawnify and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
